Do you need a permit to redo your driveway?

The line that decides it

Replacing in the same footprint — same dimensions, same location, existing legal driveway — generally does not require a permit. You are maintaining something that already exists.

Building a new driveway where there was not one, widening an existing one, or cutting a new curb at the street all require municipal approval.

The reason is that the City controls how much of a front yard becomes hard surface, how many vehicles can park in a front yard, and what happens to the rainwater that no longer soaks into your lawn.

The stormwater rule

Toronto requires stormwater retention for new hard surfaces above roughly 50 square metres. In practice that usually means permeable paving — wider joints over an open-graded stone reservoir that holds water and lets it infiltrate.

This catches a lot of people mid-project, because a widening that seemed like a small job suddenly needs a different and more expensive surface on the new portion.

There are municipal rebates that offset part of the cost of qualifying drainage work, which is worth applying for on any project that triggers the requirement.

Four separate rules, not one

Approval depends on four independent limits, and they do not move together:

Maximum driveway width, often tied to lot frontage and garage width.

Front-yard hard-surface proportion — a cap on how much of the front yard can be paved, regardless of driveway width.

Curb cut approval, which is separate work on the municipal road allowance.

Stormwater retention above the area threshold.

A project can satisfy three and fail the fourth. All four get checked before we quote.

Other municipalities

Vaughan, Markham, Mississauga, Brampton and Richmond Hill each set their own thresholds and processes. A width that is fine in one is refused in the next, and the timelines differ substantially.

There is no shortcut here other than checking your specific address against your specific municipality's current rules.
